TERMINAL PAY FOR ACCUMULATED SICK LEAVE

POLICY

The following provisions shall govern terminal compensation for accumulated sick leave.

I. Employees terminating their employment who are not eligible to transfer accumulated sick leave within the state of Florida may receive terminal pay as follows, however, not to exceed values as determined by law.

II. Instructional and Educational Support Employees

A. Those with three (3) years or less of Okeechobee service shall receive an amount equal to thirty-five percent (35%) of their base daily rate of pay for each accumulated day.

B. Those with four (4) to six (6) years of Okeechobee service shall receive an amount equal to forty percent (40%) of their base daily rate of pay for each accumulated day.

C. Those with seven (7) to nine (9) years of Okeechobee service shall receive an amount equal to forty-five percent (45%) of their base daily rate of pay for each accumulated day.

D. Those with ten (10) to twelve (12) years of Okeechobee service shall receive an amount equal to fifty percent (50%) of their base daily rate of pay for each accumulated day.

E. Those with thirteen (13) or more years of Okeechobee service shall receive an amount equal to seventy-eight percent (78%) of their base daily rate of pay for each accumulated day.

F. Upon full retirement, employees shall receive an amount equal to one hundred percent (100%) of their base daily rate of pay for each accumulated day. Full retirement is defined as that wherein no reduction in benefits is made because of age or years of service.

III. Other Full Time Employees

Full time employees who are not classified as instructional staff or educational support employees as defined by law shall be eligible for terminal sick payment at the time of normal retirement as follows:

A. Terminal pay from sick leave accrued prior to July 1, 2004, shall be paid at the daily base rate of pay at the time of retirement.

B. Terminal pay for sick leave accrued after June 30, 2004, shall be paid at the base rate of pay at the time it was earned.

C. Terminal pay from sick leave accrued after June 30, 2004, as a member of the instructional staff or as an educational support employee, shall be paid at the daily base rate of pay at the time of retirement.

D. Payment shall be calculated according to the schedule in 2(a) - 2(f).

IV. Deferred Retirement Option Program

Employees electing to participate in the Deferred Retirement Option Program (DROP) shall be eligible for terminal payment of sick leave as described in Policy 5.216.

V. It is the responsibility of the employee to complete the necessary forms for payment of sick leave within thirty (30) days of termination. If termination of employment is due to death of the employee, the employee’s personal representative shall complete the necessary forms required within thirty (30) days of the employee’s death.
